County finds workable solutions to address applications in violation of the Commercial Medical Marijuana Land Use Ordinance

On Tuesday May 7th, the Humboldt Board of Supervisors heard testimony from Humboldt County Growers Alliance, and other members of the public, for the purpose of directing the Planning Department to develop solutions toward negotiating settlement agreements for applications in violation of the Commercial Medical Marijuana Land Use Ordinance. After much discussion the Supervisors agreed that a one-size-fits all approach to addressing violations was not in the best interest of the burgeoning industry, many of whom are trying to do the right thing, but could be facing significant penalties if the Planning Department used an “all stick” approach to working with farms and business that are seeking to become legitimate. The Planning Department was directed to work with permittees on a case-by-case basis to assess the scope of violation, determine the sincerity of the applicant in moving forward with compliance, and if needed, base fines on the severity of the violation.
